New Jersey Workers' Compensation Attorney

Former Municipal Prosecutor & Judge | 42+ Years of Experience | Se Habla Español

When you are injured at work, the last thing you should have to worry about is whether your employer or their insurance company will treat you fairly. Unfortunately, workers' compensation insurers routinely deny valid claims, delay treatment approvals, and pressure injured workers into accepting settlements far below what they deserve. At the Law Office of Hector I. Rodriguez, we have spent over 42 years fighting to ensure injured workers in New Jersey receive every benefit the law provides.

Fighting for Your Full Benefits

New Jersey's Workers' Compensation Act (N.J.S.A. 34:15-1 et seq.) is a no fault system, meaning you do not need to prove your employer was negligent to receive benefits. If you were injured while performing your job duties or developed an illness related to your work conditions, you are generally entitled to compensation. This includes both sudden injuries (falls, equipment accidents, lifting injuries) and occupational diseases that develop over time (repetitive stress injuries, chemical exposure, hearing loss).

Benefits Available Under NJ Workers' Comp

  • Medical Treatment: All reasonable and necessary medical care related to your work injury must be covered by the employer's insurance carrier, including surgery, physical therapy, prescriptions, and specialist visits. You have the right to choose your own physician.
  • Temporary Disability Benefits: If your injury prevents you from working, you are entitled to 70% of your average weekly wage (subject to statutory maximums) for the duration of your disability. These payments begin after a seven day waiting period.
  • Permanent Partial Disability: If you have lasting impairment after reaching maximum medical improvement, you may receive additional weekly payments based on the percentage of disability and the body part affected. New Jersey uses a schedule of payments tied to specific body parts and functions.
  • Permanent Total Disability: If your injury leaves you unable to perform any gainful employment, you may be entitled to 450 weeks of benefits at 70% of your average weekly wage, with potential for additional payments beyond that period.
  • Death Benefits: If a workplace accident results in death, dependents are entitled to 70% of the deceased worker's average weekly wage plus burial expenses up to $3,500.

Common Employer and Insurer Tactics

Insurance companies are in the business of minimizing payouts. Common tactics include disputing whether the injury is work related, sending you to their chosen doctor for an independent medical examination (IME) designed to minimize your disability rating, delaying authorization for treatment, and offering lowball settlements before you understand the full extent of your injuries. Having an experienced attorney levels the playing field and ensures these tactics do not succeed.

The Claims Process

After a workplace injury, you must report the incident to your employer as soon as possible. Your employer is required to file a report with their insurance carrier. If your claim is accepted, benefits should begin promptly. If it is denied or disputed, you have the right to file a claim petition with the New Jersey Division of Workers' Compensation. Cases are heard by workers' compensation judges in the district where the injury occurred. Mr. Rodriguez has extensive experience navigating this system, from initial filings through hearings, appeals, and settlement negotiations.

Statute of Limitations

In New Jersey, you generally have two years from the date of injury (or from the date you knew or should have known the injury was work related) to file a workers' compensation claim petition. For occupational diseases, the timeline runs from the date of last exposure or the date of disablement. Do not let these deadlines pass. Contact us immediately if you have been injured at work.

Se Habla Español

Many of our workers' compensation clients come from New Jersey's large and hardworking Latino community. We provide all consultations and legal services in Spanish. Your immigration status does not affect your right to workers' compensation benefits in New Jersey. If you are injured on the job, you have the right to medical treatment and wage replacement regardless of your documentation status.
